1Platform Nature & Bilateral Bailment Framework
FlightLink CX-3 (“Platform”, “we”, “us”) operates solely as a technological intermediary and peer-to-peer facilitation marketplace. The Platform connects registered owners of ASA CX-3 Flight Computers (“Lenders” or “Bailors”) with student pilots and aviation candidates (“Renters”, “Lessees”, or “Bailees”).
All equipment rental transactions facilitated via FlightLink are strictly bilateral contracts governed by Chapter IX (“Of Bailment”) of the Indian Contract Act, 1872. Ownership and legal title of the equipment remain strictly vested in the Lender at all times. The Lessee receives temporary, permissive possession solely for personal DGCA examination preparation.
2Eligibility & Lessee Aadhaar Identity Storage
To rent equipment on FlightLink, candidates must:
- Be at least 18 years of age and competent to enter into a legally binding contract under Indian law.
- Provide a valid 12-digit Aadhaar number (and optional document copy), which is recorded and stored securely by the Platform in identity escrow to protect the bailor's equipment.
- Provide accurate, verifiable shipping and contact details (mobile phone, delivery address, and pincode).
- Explicitly consent to the conditional disclosure of their stored Aadhaar details to the lender in the event of a non-return dispute.
3Rental Duration & 10% Platform Unlock Fee
Duration Limit: In accordance with DGCA examination schedules, all rental periods are capped at a maximum of 10 calendar days.
Platform Facilitation Fee: FlightLink charges a transparent 10% platform facilitation fee on the base rental amount. The Lessee pays this fee via instant UPI directly to the platform admin, who verifies the payment within 1 hour.
Direct Rental & Deposit Settlement: The rental fee balance (90%) and the refundable security deposit (standard ₹10,000) are settled directly between Lessee and Lender. The deposit is refunded in full to the Lessee upon the Lender's safe return inspection.
4Delivery Guarantee & Bailment Obligations
- Target Delivery Guarantee: The order will be received by the Lessee on or before the selected start date. To ensure timely delivery, the Lender must ship at least 7 calendar days prior for intercity shipments (different city) or at least 2 calendar days prior for local shipments (same city).
- Lessee Return Dispatch SLA: The Lessee must package and courier the calculator back on or before their selected end date with a valid courier tracking slip.
- Duty of Care (Section 151): The Lessee is bound to take reasonable care of the bailed CX-3 computer as a person of ordinary prudence would of their own goods.
5Non-Return Disputes & Lender Appeal Protocol
If a Lessee fails or refuses to return the ASA CX-3 flight computer post-examination, the Lender may file an appeal through the Platform.
Upon filing and review of a non-return appeal, the Platform releases the Lessee's stored Aadhaar number, contact dossier, and delivery address directly to the Lender.
The Lender is legally entitled to utilize these disclosed records to initiate independent civil recovery, issue a legal notice under the Indian Contract Act, 1872, or lodge a formal police complaint (FIR) for criminal breach of trust (Section 316 of Bharatiya Nyaya Sanhita, 2023 / Section 405 IPC).
6Strict Website Owner Non-Liability Charter
Clear Intermediary Disclaimer:
In no way does the website owner have any relation, authority, or duty to put charges, penalties, or debt collection on the lessee.
The website owner is solely an intermediary technology host under Section 79 of the Information Technology Act, 2000. The website owner does not own the hardware, is not a party to the equipment bailment contract, and assumes zero financial, legal, or physical liability for lost, delayed, damaged, or unreturned calculators.
The lender acknowledges that their sole and complete recourse in the event of an unreturned calculator is to take direct civil or police action against the lessee after filing an appeal and receiving the lessee's stored Aadhaar details.
